- INTRODUCTION AND GOVERNING LAW
These are the Terms & Conditions of Sale applicable to all on-line purchases from Coastwatch.
These terms and the laws of Queensland, Australia, apply to all transactions for the purchase of products ("Products") from Coastwatch through its website at store.coastwatch.com.au and any associated web page ("the Website"). These terms represent the complete agreement between Coastwatch and the Purchaser covering the purchase of Products from this website. Except for terms implied by applicable legislation, Coastwatch does not offer or agree to any conditions, warranties, guarantees or representations relating to the quality, description or performance characteristics of the Products other than those set out in these terms. The Purchaser's completion of the order on this site will constitute an offer to the Purchaser to purchase Products (the "Order"). All Orders are subject to acceptance by Coastwatch.
- PRICES
All prices appearing on this website are in Australian dollars (AUD).
The prices to be paid by the Purchaser for all Products will be Coastwatch's current selling price on the date of receipt by Coastwqatch of the Order, less any applicable discounts in effect at that time. All Orders will attract a delivery charge as displayed when checking out, in the case of items nominated as "bulky items" a separate freight charge may be applicable - we will contact you once we receive confirmation of order if this is the case.
Coastwach will not be responsible for errors in pricing that appear on the Site. Coastwatch will notify a Purchaser in the event of a pricing error on the Website before an Order is delivered. The Purchaser will have the opportunity to cancel their Order within a reasonable time.
Coastwatch reserves the right to change its prices from time to time without prior notice to the Purchaser. All prices in this website include Australian Goods and Services Tax (GST) at 10%.
The GST payable by the Buyer will be shown on the invoice which Coastwatch will send to the Buyer. Delivery charges to the nominated address will be advised to the Purchaser on the Checkout and Order confirmation pages of the Site.
All international postage does not include any applicable Duty, Taxes or Clearance fees that may be payable in specific Countries.
- STOCK AVAILABILITY
By purchasing from our Website, the Purchaser accepts that Coastwatch may not have all items in stock at the time of purchase and it is possible a delay may be experienced in delivery. Occasionally, Coastwatch are unable to source items that are listed on this website for an extended period, in which case the Purchaser will be notified as soon as Coastwatch becomes aware of non-availability of the item and the full amount paid by the Buyer for the item will be refunded. Unless otherwise nominated, if the expected delivery time is likely to exceed 14 days, Coastwatch will contact the Purchaser to advise of this.
- ORDER ACKNOWLEDGEMENT AND CANCELLATION
All Orders by the Purchaser under this Agreement must be placed via the forms provided on this Website and must specify the information requested, including (but without limitation):
(a) Quantity and description of Products;
(b) The full street address to which the Product is to be delivered;
The Purchaser must complete all information requested on the Order form before the Order is processed by Coastwatch.
Coastwatch will not accept orders:
(a) If the Purchaser does not offer to pay by one of the payment methods listed in this website; or
(b) If the Purchaser's credit card provider does not confirm the payment.
Coastwatch will send the Purchaser an e-mail acknowledging the Products ordered as soon as possible after the Buyer places an Order. If Coastwatch does not accept the Purchaser's Order for any reason, it will inform the Purchaser by email in the same manner.
If the Purchaser wishes to cancel an Order prior to shipment, the Buyer must contact Coastwatch immediately on 1300 246 953 and/or e-mail info@marineleisureindustrial.com.au. Coastwatch will endeavour to accommodate the Purchaser's request, if the merchandise has not been shipped / or manufactured to suit their requirements.
If the Purchaser's entire order is cancelled prior to shipment, Coastwatch will apply a credit to the Purchaser and may also apply a cancellation fee.
If an Order has already shipped, Coastwatch's normal returns and exchanges procedure will apply.
- DELIVERY
Shipment will occur as soon as the ordered items are in stock. A Purchaser can arrange collection of Orders from Coastwatch either in person or via alternative courier.
The Purchaser acknowledges that Coastwatch may, from time to time, be subject to production, delivery or other unforeseen delays and that Coastwatch may allocate distribution of Products ordered among its customers at its sole discretion.
If the Purchaser's Order has not been delivered within a reasonable time, the Purchaser should contact Coastwatch at info@coastwatch.com.au. Coastwatch reserves the right to make partial delivery of an Order.
5.1 Shipping Option (Australia Only): Bulky / Oversized Order - Freight Estimated (Final Fees to be calculated after checkout) - this is an estimate provided for the approximate weight and length of the oversized goods. If freight costs exceed these estimates (particularly to remote areas of Australia) we may contact you for an additional payment. To date estimates have been quite accurate and we have rarely needed to do this.
- PAYMENT
Payment for Products purchased from Coastwatch via the Website can be made by "Shop Pay", Credit Card, Paypal, or Google Pay.
Coastwatch will verify the credit card information submitted by the Buyer and will advise the Purchaser that the Order has been accepted. The Purchaser agrees to submit to Coastwatch such information as may be reasonably requested by Coastwatch for the authorisation and verification of its credit card purchases.
Coastwatch reserves the right to exercise its lawful remedies if a dispute arises over payment through the Purchaser's credit card provider. In particular, but without limitation, if the Purchaser's credit card provider rejects a payment when due, Coastwatch at its discretion may delay or cancel delivery of Orders placed by the Purchaser.
Coastwatch may also offset and deduct from any refund due to the Purchaser all sums owed by the Purchaser to Coastwatch. If the Purchaser's account is placed in collection, Coastwatch will be entitled to claim all reasonable expenses for collection, including legal fees incurred in connection therewith.
- RETURNS
7.1 Defective Items and Warranties
All parts are covered only by manufacturer’s warranties and/or guarantees.
If an item arrives in not new condition as a result of a manufacturer defect, or a defect occurs during the intended use of the product, please contact us on 1300 246 953 for further information.
Coastwatch does not reimburse for labour, incidental, or any other costs related to the installation of products under any circumstance.
7.2 Incorrect Supply of Order
If, due to a warehouse or other error on the part of Coastwatch, the Purchaser receives a Product which does not conform to its Order, the Purchaser must contact Coastwatch within seven days of receipt of the Product and complete a Return Request. On approval of the Return Request and receipt of the incorrect Product back into Coastwatch's store, the correct Product will be posted to the Purchaser at no extra cost to the Buyer. Postage for return of the incorrect Product and for supply of the correct Product to the Purchaser will be paid by Coastwatch. The incorrect Product must be returned in new condition in its original packaging and unopened.
7.3 Incorrect Part Ordered by the Buyer Or Change Of Mind Purchases
If the incorrect Product is ordered by the Purchaser, the Purchaser must contact Coastwatch within seven days of receipt of the Product and complete a Return Request. On approval of the Return Request and receipt of the incorrect Product back into Coastwatch's store, Coastwatchwill refund the price paid for the Product. Postage for return of the incorrect Product will be paid by the Buyer. The incorrect Product must be returned in new condition in its original packaging and unopened. If a replacement Product is required, the Purchaser may complete a new Order for the correct Product and the new Order will be treated as a separate and new transaction.
Coastwatch is not obliged to refund any monies where the Purchaser has changed their mind on their purchase. In particular no returns will be accepted for customised or specifically manufactured products. Goods returned may incur a restocking fee of 15% to Coastwatch and will be fully charged to the customer as well as any freight charges and bank charges.
7.4 Damaged Shipments
All packages should be completely inspected at the time of delivery. Damaged packages should be refused. Please then call the freight company or Australia Post (whoever is responsible for the package) and report the damage. After contacting the carrier, please call Coastwatch on 1300 246 953 for further assistance with the damaged shipment, and to make arrangements for a replacement.
7.5 Manufactured / Custom Products
Manufactured / Custom products are not returnable under any circumstances.
7.6 How to complete Return Request
Please contact Coastwatch on 1300 246 953 or info@coastwatch.com.au . We will respond to your request as soon as possible.
8 FREIGHT METHODS
Coastwatch will arrange delivery of all Products to the Customer using its nominated freight carriers. A Purchaser may arrange its own courier to collect the Products from Coastwatch, though prior arrangements need to be made with Coastwatchto accomodate this.
To find out how much postage/shipping will be, add the product(s) you want to purchase to your shopping cart. You can then "View Cart" and you are able to see freight charges at checkout. If you have any problems, please contact us.
Where possible, for orders up to 20kg in actual or cubic weight (whichever is the highest), we use Australia Post for delivery as it has the greatest reach to the domestic and international market through delivery partners.
If the freight cost is higher than the estimated price at checkout we may contact you and inform you of the actual cost and allow you to decide if you would like to pay the extra cost or negotiate a refund.
Your tracking number will also appear in the email we will send you when your order has been completed.
9 RETENTION OF TITLE
The Products and any other goods delivered by Coastwatch to the Purchaser shall remain the sole and absolute property of Coastwatch as legal and equitable owner until such time as all money due to Coastwatch has been paid but shall be at the Purchaser's risk from the time of delivery. We recommend postal insurance if you would like added security.
10 DISCLAIMER
All information, services, products, and materials contained in this site, including text, graphics, and links, are provided on an "as is" basis with no warranty. To the maximum extent permitted by law, Coastwatch disclaims all representations and warranties, express or implied, with respect to such information, services, products and materials, including but not limited to warranties of merchantability, fitness for a particular purpose, title, non-infringement, freedom from computer virus, and implied warranties arising from course of dealing or course of performance. In addition, Coastwatch does not represent or warrant that the information accessible via this site is accurate, complete or current. Price and availability information is subject to change without notice.

You agree that Coastwatch is not responsible for the availability of, or the content located on or through, any external site.
